I, JOHN ACKERMAN, hereby acknowledge and undertake as follows:

Allegations :

1. I acknowledge that I am currently facing allegations of professional misconduct in relation to College File No. 180528-0101 that were referred to the Discipline Committee of the College of Massage Therapists of Ontario (the "College") on September 30, 2019. This matter arose out of a complaint received by the College on May 28, 2018 and involves allegations of sexual abuse in relation to massage therapy treatments provided to Client #1, as well as failing to keep records as required ("Matter #1"}.:

2. I acknowledge that I am also currently the subject of the following complaints and investigation, which are ongoing: :

a. College File 181005-0201 is an investigation into criminal charges of sexual assault against me that are ongoing ("Matter #2"}:

b. College File 190115-0101 is a formal complaint filed by one of the individuals involved in the criminal matter ("Matter #3"} :

c. College File 190917-0101 is a formal complaint filed by one of the individuals involved in the criminal matter ("Matter #4")

3. acknowledge that I am entering into this Acknowledgement and Undertaking in exchange for the College agreeing to indefinitely adjourn the discipline hearing against me in Matter #1 (to be reinstituted if I breach this Acknowledgement and Undertaking). :

4. I understand and acknowledge that the College's investigations into Matters #2, 3, and 4 will continue and that these matters may proceed in accordance with section 14 of the Health Professions Procedural Code, being Schedule 2 to the Regulated Health Professions Act, 1991 (the "Code") even though I have resigned my certificate of registration with the College. :

Resignation with Undertaking to Never Re-Apply :

5. I undertake to resign my membership in and certificate of registration with the College immediately upon the signing of this Acknowledgement and Undertaking. :

6. I undertake never to reapply for membership, registration, licensure or similar status as a massage therapist with the College or any other massage therapy regulat ory body in Canada. :

7. I acknowledge that if I ever apply for membership, registration, licensure or similar status with the College or any other massage therapy regulatory body in Canada in the future, the College will be entitled to rely upon this Acknowledgement and Undertaking in any registration or other similar proceeding as reason to deny my application. :

8. I acknowledge that once my resignation is tendered, I will not be entitled to use the title "massage therapist" or "registered massage therapist", "MT", "RMT", or any abbreviation thereof or equivalent in another language, I will not be entitled to hold myself out as a person who is qualified to practise in Ontario as a massage therapist or in a specialty of massage therapy and I will not be entitled to imply that I am a massage therapist in Ontario or in any other jurisdiction in Canada. :

9. I further acknowledge that if I ever apply for membership, registration, licensure or similar status with the College or any other massage therapy regulatory body in Canada in the future, the College will be entitled to reinstitute the prosecution in Matter #1, the College will also be entitled to prosecute me for a breach of this Acknowledgement and Undertaking, and the College will be entitled to rely upon this Acknowledgement and Undertaking for those purposes. :

Funding and Security for Funding:

10. I undertake to reimburse the College for funding provided to Client #1 in Matter #1 under the program required under section 85.7 of the Code. :

11. I further undertake to post security acceptable to the College in the amount of $8,000 within 15 days of the date of this Acknowledgement and Undertaking to guarantee the payment of any amounts I may be required to reimburse the College as a result of the undertaking contained in paragraph 10 above. I acknowledge that any security that has not been used by the College to provide funding to Client #1 in Matter #1 as of May 28, 2023 will be returned to me. :

Other :

12. I acknowledge that if I ever breach any part of this Acknowledgement and Undertaking the College will be entitled to reinstitute the prosecution of Matter #1, and the College will also be entitled to prosecute me for a breach of this Acknowledgement and Undertaking, and that such prosecution and investigation may proceed in accordance with section 14 of the Code even though I have resigned my certificate of registration with the College. :

13. I acknowledge that the College will include the full text of this Acknowledgement and Undertaking on the public register of the College, which is located on the College's website. :

14. I further understand, acknowledge and agree that: :

a. I fully understand the terms of this Acknowledgement and Undertaking;

b. I am signing this Acknowledgement and Undertaking voluntarily and without compulsion or duress; and

c. I have been advised by the College to obtain independent legal advice prior to signing this Acknowledgement and Undertaking and I have either done so or I have had an adequate opportunity to do so.
