Detail(s)On April 9, 2019, Mr. Loris Colasanti signed an undertaking as follows:

I, LORIS COLASANTI, hereby acknowledge and undertake as follows:

1. I acknowledge that I am a duly registered member of the College of Massage Therapists of Ontario (the CMTO).

2. I acknowledge that on or about March 20, 2019, I was charged with one count of sexual assault contrary to section 271 of the Criminal Code. This charge was made public on March 21, 2019, by the Peel Regional Police. The charge is outstanding.

3. I further acknowledge that the CMTO has received complaints from eight different complainants alleging that I sexually abused them during the course of a massage therapy treatment session. The CMTO file numbers for these complaints are 190318-0101, 190322-0102, 190322-0103, 190322-0104, 190322-0105, 190322-0106, 190325-0101 and 190325-0102.

4. I acknowledge that it is in my interest to focus on defending the criminal charge against me.

5. In exchange for the CMTO agreeing to delay starting any discipline proceeding against me until the criminal charge has been resolved, I hereby undertake to cease practising massage therapy, to cease holding myself out as a massage therapist, and to cease using the title “massage therapist” or “registered massage therapist” or any abbreviation thereof or equivalent in another language, until such time as the criminal process and any CMTO discipline process related to the criminal charge and any of the complaints listed above in paragraph 3 of this Undertaking, have concluded.

6. I further agree that my registration status will be changed from “general certificate” to “inactive” upon signing this Acknowledgement and Undertaking.

7. I acknowledge that the College will include the full text of this Acknowledgement and Undertaking on the public register of the CMTO which is included on the CMTO website.

8. I acknowledge that a breach of this Acknowledgement and Undertaking would constitute professional misconduct for which I can be prosecuted. I further acknowledge that the CMTO would be entitled to rely on this Acknowledgement and Undertaking for that purpose.

9. I acknowledge that a breach of this Acknowledgement and Undertaking would entitle the CMTO to prosecute me for the concerns that led to the criminal charge against me as well as the complaints listed in paragraph 3 of this Undertaking and I acknowledge that the CMTO is entitled to rely on this Acknowledgement and Undertaking for that purpose, as well as the underlying information that led to the criminal charge and the complaints.

10. I acknowledge that this Acknowledgement and Undertaking relates only to the criminal charge laid against me on or about March 20, 2019 and the complaints listed in paragraph 3 of this Undertaking, and that if there are any additional criminal charges laid against me or additional complaints made to the CMTO, the CMTO may take whatever steps it is authorized to take under the Health Professions Procedural Code in relation to any additional charges.

11. I acknowledge that I have had the opportunity to obtain legal advice prior to entering into this undertaking and I have either done so or I have chosen not to do so.

12. I acknowledge that I am entering into this undertaking freely, voluntarily and without duress.
